Terms of Service

Preamble

These Terms of Service are concluded between:


  • the manager of the website, hereinafter referred to as “the Publisher”,
  • any person wishing to access the site and its services, hereinafter referred to as “the User”.

1 – Principles

These Terms of Service aim to provide the legal framework for the use of the Up Review website and its services.

The Terms of Service must be accepted by all users, and access to the site constitutes acceptance of these terms.

2 – Changes and Duration of the Terms

These Terms of Service are concluded for an indefinite period. The agreement takes effect with respect to the User from the start of use of the service.


Up Review reserves the right to modify the provisions of these Terms of Service at any time and without justification.

3 – Access to the Site

Any user with internet access can access the Up Review site free of charge from anywhere. The costs incurred by the User to access it (internet connection, computer equipment, etc.) are not borne by the Publisher.


The site and its services may be interrupted or suspended by the Publisher, including for maintenance, without prior notice or justification.


The User has access to the following services: games to try to win products from the brand providing platform access.

4 – Responsibilities

The Publisher cannot be held liable in the event of a failure, breakdown, difficulty, or interruption of operation preventing access to the site or one of its functionalities.


The equipment used to connect to the site is the sole responsibility of the User, who must take all appropriate measures to protect equipment and data, particularly against internet viruses. The User is also solely responsible for the sites and data consulted.


The Publisher cannot be held liable in the event of legal proceedings against the User:


  • due to the use of the site or any service accessible via the internet;
  • due to the User’s failure to comply with these Terms of Service.


The Publisher is not responsible for damages caused to the User, third parties, and/or the User’s equipment due to the connection or use of the site, and the User waives any action against the Publisher as a result.


Should the Publisher be subject to an amicable or judicial procedure as a result of the User’s use of the site, the Publisher may take action against the User to obtain compensation for all damages, sums, judgments, and expenses that may arise from such a procedure.

5 – Intellectual Property

All technical documents, products, photographs, texts, logos, drawings, videos, etc., are subject to copyright and protected by the French Intellectual Property Code. When provided to clients, they remain the exclusive property of Up Review, the sole holder of the intellectual property rights over these documents, which must be returned upon request.


Clients agree not to use these documents in any way that could infringe the industrial or intellectual property rights of the supplier and agree not to disclose them to any third party without the express prior written authorization of the Publisher.

6 – Hyperlinks

The creation by the User of any hyperlinks to all or part of the site is strictly prohibited without the prior written authorization of the Publisher, requested by email at contact@upreview.fr.


The Publisher is free to refuse such authorization without having to justify its decision in any way. If authorization is granted, it is in any case only temporary and may be withdrawn at any time, without obligation of justification by the Publisher.


In all cases, any link must be removed upon simple request from the Publisher.


Any information accessible via a link to other sites is not under the control of the Publisher, who declines all responsibility for their content.

7 – Protection of Personal Data

Amendments to this Clause


The website reserves the right to modify this data protection clause at any time. If a change is made, the website undertakes to publish the new version online and to inform Users by email at least 15 days before its effective date. If the User disagrees with the terms of the new clause, they may delete their account.

8 – Cookies

Up Review may automatically collect standard information. All information collected indirectly will only be used to monitor the volume, type, and configuration of traffic using this site, to develop its design and layout, and for other administrative and planning purposes and more generally to improve the service we offer you.

9 – Gifts and Rewards

Up Review is not responsible for the creation and configuration of shops on the platform. Up Review is also not responsible for gifts, probabilities, or inability to provide rewards to users. Clients are invited to contact the legal entity (shop, restaurant, etc.) providing the platform for any request.

10 – Applicable Law

Any dispute relating to these Terms of Service, the use of our services, or the contractual relationship between the User and Up Review shall be subject to the exclusive jurisdiction of the courts of Montpellier, France, unless otherwise provided by law.
