Read Up Review's Terms of Service: usage rules, rights and responsibilities of platform users, plus how your account and data are handled.

Preamble

These terms of service are entered into between:

the manager of the website, hereinafter referred to as the "Publisher",

any person wishing to access the site and its services, hereinafter referred to as the "User".

1 - Principles

The purpose of these terms of service is to provide the legal framework for the use of the Up Review website and its services.

These terms of service must be accepted by every User, and accessing the site constitutes acceptance of these terms.

2 - Changes to and duration of these Terms of Service

These terms of service are entered into for an indefinite period. The agreement takes effect with respect to the User from the moment they begin using the service.

Up Review reserves the right to modify the clauses of these terms of service at any time and without justification.

3 - Access to the site

Any User with internet access can access the Up Review site free of charge, from anywhere. Costs incurred by the User to access the site (internet connection, computer equipment, etc.) are not borne by the Publisher.

The site and its various services may be interrupted or suspended by the Publisher, in particular for maintenance purposes, without any obligation of prior notice or justification.

The User of the site has access to the following services: games offering a chance to win Products from the brand that provides them with access to the platform.

4 - Liability

The Publisher's liability cannot be engaged in the event of failure, breakdown, difficulty or interruption of operation preventing access to the site or to any of its features.

The equipment used to connect to the site is the sole responsibility of the User, who must take all appropriate measures to protect their equipment and data, in particular against viral attacks via the internet. The User is furthermore solely responsible for the sites and data they access.

The Publisher cannot be held liable in the event of legal proceedings against the User:

  • arising from the User's failure to comply with these terms of service

Should the Publisher become subject to an amicable settlement procedure or legal proceedings as a result of the User's use of the site, it may take action against the User to obtain compensation for any losses, sums, judgments and costs that may result from such proceedings.

5 - Intellectual property

All technical documents, products, photographs, texts, logos, designs, videos, etc. are subject to copyright and are protected under the Code de la propriété intellectuelle (French Intellectual Property Code). When provided to our clients, they remain the exclusive property of Up Review, the sole holder of the intellectual property rights over these documents, which must be returned to Up Review upon request.

Our clients agree not to make any use of these documents that could infringe the supplier's industrial or intellectual property rights, and agree not to disclose them to any third party without the prior express authorization of the Publisher.

Users are strictly prohibited from setting up any hyperlinks to all or part of the site, unless prior written authorization has been obtained from the Publisher by emailing: contact@upreview.fr

The Publisher is free to refuse this authorization without having to justify its decision in any way. Should the Publisher grant such authorization, it is in all cases only temporary and may be withdrawn at any time, without any obligation on the Publisher to provide justification.

In all cases, any link must be removed upon simple request from the Publisher.

Any information accessible via a link to other sites is not under the control of the Publisher, which disclaims all liability regarding its content.

7 - Protection of personal data

Changes to this clause

Article 9 - Gifts and rewards

Up Review is not responsible for the creation or configuration of shops on the platform. Up Review is likewise not responsible for gifts, odds, or any inability to provide winnings to users. Customers are invited to contact the legal entity (shop, restaurant, etc.) that makes the platform available for any request.

Article 10 - Applicable law

Any dispute relating to these general terms and conditions of sale, the use of our services, or the contractual relationship between the User and Up Review, shall be submitted to the exclusive jurisdiction of the Montpellier Court, France, unless otherwise provided by law.
